New Requirements for Labeling Readability in Thailand

泰國對於標籤可讀性的新要求

There are new rules on product label font size and readability for the labeling requirements in accordance with the issuance of Announcement of the Label Committee Re: Characteristics of the Label for Label-Controlled Goods No. 3, which is the M&A of Thai Consumer Protection Act (“CPA”).

最近泰國對標籤要求對產品標籤字體大小和可讀性有新的規定，依據標籤委員會公告關於標籤受控商品的標籤特徵第3號的發布，這是《泰國消費者保護法》(“CPA”)的章程。

The new regulations will be effective on June 18, 2023, and will be applied to all “label-controlled goods” which are described under Thai CPA and its M&A as goods either produced by Thailand factories or imported into Thailand for sale. The new rules include having information about the product name, quantity, intended use, cautions, and expiry date. In addition, label readability is the focus of the latest announcement, which adds the mandatory requirement on the size of text on labels.

新規定將於 2023 年 6月 18 日生效，並將適用於所有“標籤受控商品”，這些商品在泰國 CPA 及其章程被描述為泰國工廠生產或進口到泰國銷售的商品。新規則包括有關產品名稱、數量、預期用途、注意事項和有效期的資訊。此外，標籤可讀性是最新公告的重點，增加對標籤文字大小的強制性要求。

The requirements on text size are important to ensure consumers are fully aware of the details of the product before deciding to purchase it. Based on the announcement, any statement or text displayed on a label must be easily visible and readable. The size of the text must be proportional to the label area. In addition, the text height must not be less than 2 millimeters. However, the announcement does not indicate how the height of the text will be determined.

文字大小的要求對於確保消費者在決定購買產品之前充分了解產品的細節非常重要。根據公告，標籤上顯示的任何聲明或文字必須易於查看和閱讀。文字的大小必須與標籤區域成正比。此外，文字高度不得小於 2 毫米。不過，公告並未說明將如何確定文字高度。

Some companies will have pressure because these requirements are too strict to follow, especially for small businesses. The text size requirements may cost a lot because larger text requires more space on the label, potentially leading to larger labels or packages, and some products may need to be recalled to affix the new labels. In some conditions, text size requirements may even make it impossible to fit all the required information on the label.

一些公司會有壓力，因為這些要求太嚴格而無法遵循，特別是對於小型企業。文字大小要求可能會花費很大，因為較大的文字需要標籤的更多空間，可能導致標籤或包裝更大，並且可能需要召回某些產品以貼上新標籤。在某些情況下，文字大小要求甚至可能導致無法在標籤上顯示所有必需的資訊。

It can lead to a fine of THB50,000 imprisonment or one month imprisonment, or both according to the Consumer Protection Act, 1979, Section 53 for violation of these regulations. Furthermore, trading partners selling label-controlled products can be penalized, too. Certain trading partners may be banned from placing products for sale on their trading platforms.

如果違反這些規定，依據《1979年消費者保護法》第53條可能會被處以 50,000 泰銖的罰款、一個月的監禁或兩者併罰。此外，銷售標籤控制產品的貿易夥伴也可能受到處罰。某些貿易夥伴可能被禁止在其交易平台上架產品進行銷售。
