Setting up A Recruitment Company in Thailand

在泰國設立招聘公司

Currently, many investors set up companies in Thailand due to its tax and non-tax incentives to prosper Thai economy. When hiring employees in Thailand, company can complete the recruitment procedure on its own, or the company can request the service of recruitment companies.

由於稅收和非稅收優惠以及繁榮的經濟，目前許多投資者在泰國設立公司。公司在泰國招聘員工，可自行進行聘僱手續，也可委託招聘公司提供服務。

When a foreign investor wants to set up a recruitment company in Thailand, having a local partner is required. Most investors decide to set up limited liability companies which offer various benefits.

當外國投資人想在泰國設立招聘公司，需要當地合作夥伴。大多數投資者決定成立提供各種好處的有限責任公司。

To set up a recruitment company under the Employment and Job Seeker Protection Act, 1985 requires the following:

根據 1985 年《就業和求職者保護法》設立招聘公司需要符合以下條件：

• have the company’s incorporation documents drafted and notarized;

      起草並公證 公司的設立文件;

• have their identification papers translated and notarized and then filed with the Trade Register;

      翻譯和公證他們的身份證件， 然後提交給貿易登記處;

• obtain the tax identification number with the local tax authorities;

      向當地稅務機關取得 稅籍編號;

• find a suitable location for the Thai employment agency (apply for special requirements);

      為泰國職業介紹所尋找 合適的地點（特殊申請要求）;

• apply for the recruitment license with the Labor Department in Thailand.

      向泰國勞工部申 請招聘許可證。

In addition, when providing recruitment service in Thailand, recruitment license is required for business operations. There are two types of licenses a company can obtain to run a recruitment business in Thailand. One is the license for executing outbound recruitment activities, and the other is domestic recruitment activities. Foreign business owners are granted to apply for both licenses.

此外，在泰國提供招聘服務，需要獲得招聘許可證才能開展業務。公司在泰國開展招聘業務可以獲得兩種類型的許可證。一種是開展境外招聘活動的許可證，另一種是開展國內招聘活動的許可證。外國企業主可以申請這兩種許可證。

To obtain a recruitment license requires the following:

要獲得招聘許可證，需要滿足以下條件：

• The company office must be at least 16 square meters big, be clearly separated from other companies, to show the company name in the front of the office. Having a consent letter from the landlord confirming the use of the address for this purpose is required. The official will inspect the office before issuing the approval and will perform yearly inspection without the need of having advanced notice;

公司辦公 室必須至少16平方米大，與其他公司明顯分開，並在辦公室前面顯示公司名稱。需要房東的同意書，確認將地址用於此目的。官員將在簽發批准前檢查辦公室，並將在不需提前通知的情況下進行年度檢查;

• The director will need to present a copy of the criminal records;

      董事將需要出示犯罪 記錄影本;

• Different regulations for domestic and outbound recruitment according to the Employment and Job Seeker Protection Act, 1985.

     依據 1985年《就業和求職者保護法》境內外招聘規定不同。

Once the license application is accepted, the company needs to change the company name by adding the words “recruitment business” to its legal name. The recruitment business also has to be taken up in the company objectives. When the company submits all documents, the license will be issued within 15 working days. In addition, please be aware that the criminal record inspection may last for two months.

一旦許可申請核准，公司需要更改公司名稱，在其法定名稱中添加“招聘業務”字樣。招聘業務也必須納入公司營業目標。當公司提交所有文件後，將在15 個工作日內頒發許可證。此外，請注意犯罪記錄檢查可能會持續兩個月。

Thai recruitment companies can commence various activities, including handling human resources departments in other companies, but also help people searching for jobs to find employment opportunities.

泰國招聘公司可以開展各種活動，包括處理其他公司的人力資源部門，還可以幫助正在尋找工作的人找到就業機會。
