Can Foreigner Inherit Lands in Thailand?
外國人可否繼承泰國土地 ?
Based on international business and cross-country marriage, it is possible that one day you will receive property from a Thai spouse or other family members. Here comes a question, can a foreigner inherit Lands in Thailand?
基於國際貿易及異國婚姻，有天你有可能從泰籍配偶或是其他家庭成員繼承泰國的財產。問題是，外國人可以繼承泰國的土地嗎?
According to Section 93 of Land Code Act B.E. 2497 (1954), The Minister shall permit the inheritance of land by an alien who is the lawful heir, but such acquisition may not exceed the amount under Section 87. Therefore, apparently foreigners are able to receive property from succession. But as we have mentioned in our previous article “Land Lease in Thailand”, foreigners aren’t allowed to own lands in Thailand, which means Section 93 doesn’t apply to foreigners acquiring land by inheritance.
依據佛曆2497年（1954年）《泰國土地法》第93條規定，部長應允許國外合法繼承人繼承土地，但繼承的土地加上其他已持有的繼承物，不得超過第87條規定可以持有的數字。解釋上為外國人可繼承泰國遺產，但在我們先前的文章「泰國土地租賃」有提到，外國人不得持有土地擁有權，故《泰國土地法》第93條的內容並不包含外國人可擁有土地。
In addition, section 94 of the Act provides that all the lands which alien has acquired unlawfully or without permission shall be disposed within the time limit prescribed by the Director-General which shall not be less than one hundred eighty days nor more than one year. If the land is not disposed within the prescribed timeframe, the Director-General shall have the power to dispose of it.
《泰國土地法》第94條規定，外國人非法或未經許可獲得的土地，均應在局長規定的時間內脫產，該期限不得少於一百八十天，也不得超過一年。如國外繼承人未在規定的時間內將土地處理完畢，局長有權處理。
Therefore, the answer to the question “can a foreigner inherit Lands in Thailand” is yes, but this foreign successor cannot register ownership of the land because he/she isn’t given permission. Under section 94 he/she must dispose of the land within a reasonable period to a Thai national or apply to receive property from succession under exemption.
綜合前面幾段說明，外國人是可以繼承泰國土地，但無法向土地局登記土地的擁有權。依《泰國土地法》第94條規定，國外繼承人需在一定合理的時間將土地脫手給泰國人，或申請豁免權取得繼承權。
