Copyright in Thailand 泰國著作權介紹

The core value of copyright is to provide exclusive rights of the creators’ copyright works. In Thailand, copyright is governed under Copyright Act B.E. 2537 (1994) and it has been amended several times. The latest version is Copyright Act (No. 4) B.E. 2561 (2018), which was published on November 11, 2018 and has been effective since March 11, 2019. The law stated the requirements and conditions for reproduction, adaptation, and availability of copyrighted works to the disabled to be exempted from copyright infringement[1]. 

著作權的核心概念為創作者對於著作的排他權。泰國著作權相關規定請參考佛曆2537年（1994）《泰國著作權法》以及之後的修訂版。目前最新的著作權法為佛曆2561年（2018）第4號《泰國著作權法》，於2018年11月11日進行公告並於2019年3月11日生效；新法規定殘疾人士重製、改編著作權物的規定及條件，以免於侵犯他人著作權。

To obtain copyright protection, such work must be in a form of expression of an idea, expressed from an independent thinking and is legal.

要取得著作權，著作須表達一個構想，由獨立思考而來且為合法。

Copyright protection is automatic and valid when the author is alive plus an additional period of 50 years after his/her death. If the author is a legal person or an anonymous, copyright lasts for 50 years from the date of publication. If the work is unpublished, this 50-year period starts after the creation.

著作在創作完成即受著作權保護，有效期限至創作人死後50年。如創作人為法人或無名氏，著作權有效期至公開後50年；未公開的著作有效限期為創作完成後50年。

Under section 6 of Copyright Act, copyright can be obtained for literary, dramatic, artistic, musical, audiovisual, cinematographic, sound recording, sound and video broadcasting work or any other work in the literary, scientific or artistic domain whatever may be the mode or form of its expression.  

依據《泰國著作權法》第6條規定，著作權不論表達方式或形式，可藉由文學、戲劇、藝術、音樂、視聽、電影、錄音、聲音和視頻廣播作品或文學、科學或藝術領域的任何其他作品取得。

The following are not deemed as copyright work: 以下不能稱為著作：

1. news of the day and facts having the character of mere information which is not a work in literary, scientific or artistic domain,

每日新聞及純粹資訊的事實，非文學、科學或藝術領域的作品，

2. constitution and legislations,

憲法及立法，

3. regulations, by-laws, notifications, orders, explanations and official correspondence of the Ministries, Departments or any other government or local units,

政府或地方單位發出的法規、施行細則、通知、命令、解釋及正式文件，

4. judicial decisions, orders, decisions and official reports,

司法裁定、命令、 決定和正式報告，

5. translation and collection of those in (1) to (4) made by the Ministries, Departments or any other government or local units.

   政府或地方單位發出前述(1)到(4)點的翻譯及整理。

Copyright protection does not extend to ideas, procedures, processes, systems, methods of use, operations, concepts, principles, discoveries, or scientific or mathematical theories.

著作權並未擴展思想、程序、過程、系統、使用方法、操作、概念、原理、發現或科學或數學理論。

It is not required to register copyright work; however, it is possible to file your work to the Copyright Office at Department of Intellectual property (DIP). When there’s dispute regarding copyright, the recordation can be used as supporting evidence.

著作不需登記即受著作權保護，但您可以將您的作品交到「泰國商務部智慧財產局」（DIP）底下的著作權辦公室進行登記申請。當有著作權有關的爭議案件時，提交的著作登記可作為證據資料。
