Two forms of arbitration are currently recognized under Thai law, which are in-court arbitration and out-of-court arbitration.

泰國法律目前認可兩種仲裁形式，分別為庭內仲裁和庭外仲裁。

In-court arbitration involves a process at the court of first instance where the parties agree to submit the issues in dispute before the court to arbitration. It is governed by the Civil Procedure Code Sections 210 to 220 and 222, which provide for the process of setting up an arbitral tribunal.

庭內仲裁涉及一審法院的程序，雙方同意將爭議事項提交法院進行仲裁。此受《泰國民事訴訟法》第210至220和222條管轄，規定設立仲裁庭的程序。

Out-of-court arbitration is the main type of arbitration used in Thailand, regulated by Arbitration Act, which latest version is Arbitration Act (No. 2) B.E. 2562 and came into effect on 15 April, 2019. One of the most significant changes is a foreigner who is residing outside Thailand or is entitled to reside in Thailand, and who has been appointed as a foreign arbitrator or representative in an arbitration in Thailand that is to be conducted by a government agency or organization, may request from such government agency or organization a certificate to support the consideration of Thai officials on the immigration and working of aliens.

庭外仲裁是泰國主要的仲裁類型，依《泰國仲裁法》管理，最新版為佛曆2562年第2號《仲裁法》，於2019年4月15日生效。此次修法重點之一是在泰國境外居住或有權在泰國居住的外國人，並已被指定為在泰國由政府機構或組織執行進行的仲裁的外國仲裁員或代表，可以要求該政府機構或組織提供證明，以支持泰國官員考慮外國移民和移工。
