Comparison between Civil and Criminal Action in Thailand

泰國民事及刑事訴訟比較

When considering initiating a legal action or responding to an action acted by another party, one of the key points is whether either it belongs to civil action, criminal action, or both.

當您要在泰國起訴或是回應對方的行為，重點之一是要採民事或是刑事訴訟、或是兩者並行。

Below are some differences between civil and criminal actions for your reference:

1. Normally, civil action is brought before court when a party seeking enforcement or protection of a right, whereas criminal action is for punishing the offender.

通常採民事訴訟是要強制執行或是保護某個權利、而採刑事訴訟是要處罰侵犯者。

2. In criminal cases punishment usually is to be fined or imprisoned, whereas in civil cases the result is broader such as compensation or reimbursement.

刑事訴訟的處罰通常是易科罰金或是坐牢，民事訴訟的結果更為廣泛像是補償或是賠償。 

3. The present of evidence in civil action is assigned by court based on issues raised in complaint and response, while in criminal action the evidence will be questioned by both parties with reasonable consideration.

民事訴訟的證據陳列是法院依照訴求及回應規定的，然而刑事訴訟中雙方會質疑證據的真偽。

4. It needs action to send notice in some cases before filing a civil action, except that the plaintiff might send one or several warning letters before taking formal action. For criminal action, normally the authority will seek search and arrest warrant.

民事訴訟起訴前特定案件須有通知對方的前置作業，而刑事起訴前會有搜查和逮捕令。
