Sublaws under Royal Decree on Thailand Digital Platform Service

泰國數位平台服務皇家法令的子法

On 20 July 2023, Thailand’s Electronic Transactions Development Agency (ETDA) held a briefing session announcement that there will be a draft of sublaws under the Royal Decree on Digital Platform Services.[1] The sublaws are expected to be announced this month.

2023年7月20日，泰國電子交易發展局(ETDA)召開簡報會宣布，將根據《數位平台服務皇家法令》制定子法草案。這些子法預計將於本月公佈。

Following are key changes and new requirement listed in the drafted sublaws:

以下是子法律草案中列出的主要變化和新要求：

• The ETDA has drafted guidelines on the ways for identifying active users to provide digital platform service operators a better understanding of the calculation methods.

       ETDA 起草關於活躍用戶識別方式的指南，以便數位平台服務運營商更好地理解計算方法。

• The definition of “users” for calculating annual monthly active users (AMAUs) has been reduced in scope to cover only users in Thailand.

            用於計算年度月度活躍用戶 (AMAUs)的“用戶”定義範圍已縮小，僅涵蓋泰國用戶。

• E-marketplace digital platform services suspending or terminating operations for specific users must notify the affected users and to provide a period for them to challenge the suspension or termination.

    當電子交易市場數位平台服務暫停或者終止對特定用戶的運 營，應當通知受影響的用戶，並給予其對暫停或者終止提出異 議的期限。

• Digital platform service operators cannot use the requirements to recognize their active users as a legal basis for processing users’ personal data, especially for profiling and tracking activities.

                數位平台服務運營商不能將識別其活躍用戶的要求作為處理用 戶個人數據的法律依據，特別是分析和跟踪活動。

• The sublaws on announcement of terms and conditions (T&Cs) and changes to T&Cs will be effective on January 3, 2024 once it is issued, while the other sublaws will take effect immediately (i.e., August 21, 2023). This means that the ETDA admitted the private sector’s feedback that the requirements on T&Cs will take more time for operators to comply with.

            關於條款和條件 (T&Cs)公告以及條款和條件變更的子法將於發布後於2024年1月3日生效，其他子法將立即生效(即2023年8月21日)。這意味著 ETDA 承認私營部門的反饋意見，即運營商需要更多時間才能遵守條款和條件的要求。

• The requirements for changing T&Cs have been adjusted. Under the current draft, the required advance notification period can be exempted if a change in the T&Cs is for the purpose of, for example, rolling out new products or services and improving the platform.

                 調整更改條款和條件的要求。根據目前的草案，如果條款和條 件的變更是出於推出新產品或服務以及改進平台等目的，可以 免除所需的提前通知期。

• Required submissions under the Royal Decree for Digital Platform Services and its sublaws will be made through the ETDA’s online portal.

            根據《數位平台服務皇家法令》及其子法所需提交的資料將通 過 ETDA 的線上網站進行。

For certain types of digital platform services, the ETDA has the authority to announce which platforms will be designated as falling within the scope of the royal decree’s requirements.

對於某些類型的數位平台服務，ETDA 有權宣布哪些平台將被指定為屬於皇家法令要求的範圍。
