How to Register Trademarks Through Madrid System in Thailand

從泰國申請馬德里商標

The Madrid trademark registration is governed by two treaties, which are Madrid Agreement and Madrid Protocol. In other words, a natural person or a legal entity can file international trademark applications through Madrid Agreement or Madrid Protocol. Thailand has become a member of Madrid Protocol since November 7, 2017.[1]

馬德里國際商標註冊系統分為《馬德里協議》及《馬德里議定書》這兩種。也就是說，個人或企業可以透過《馬德里協議》或《馬德里議定書》成員國申請國際商標。泰國在2017年11月7日成為《馬德里議定書》的成員。

After the Thailand trademark is filed, the applicant needs to submit international application through Department of Intellectual Property (“DIP”), which will certify and forward it to WIPO.

申請人向「泰國商務部智慧財產局」(簡稱“DIP”)提出泰國商標申請並申請馬德里國際註冊，DIP會確認案件內容並轉發給WIPO。

WIPO only conducts formal examination of the application. Once approved, the mark is recorded in the International Register. The applicant will notify the DIP in all the territories where he wishes to have the mark protected.

    WIPO僅進行形式審查，核准之後案件會在國際註冊簿登記。申請人須通知DIP要指定進入的國家別。

    The IP Offices of the territories where the mark is wished to be protected will make a decision within the applicable time limit (12 or 18 months) in accordance with their legislation. WIPO will record the decisions of the IP Offices in the International Register and then notify the applicant.

各國商標註冊處收到通知後會進行實質審查(約12-18個月)，視各國商標法規而定，WIPO收到各國商標註冊處的決定後會通知申請人。

Benefits 優點

1. Convenient, it can reduce the possibility of errors or missed deadlines.

方便管理，減少錯誤或是錯過期限。

2. Cost-effective, particularly when filing in a substantial number of countries.

節省費用，特別是一次申請多國。

Cons 缺點

1. The threat of central attack: If the base application or registration on which the international registration is based is refused, withdrawn or cancelled during the first five years, such trademark cannot have the privileges under international protection.

中心打擊原則: 在國際註冊日起五年內，如基礎案沒有核准、被撤銷或被宣告無效，其效力將及於所有指定國家，此商標不能再享有國際註冊給予的保護。
