Land Lease in Thailand 泰國土地租賃

Based on current Thai laws, foreigners aren’t allowed to own land. Therefore, the preferred way of acquiring lands is through leasing. Normally there will be a lease agreement which indicates the duration of lease. If the period is less than 3 years, there’s no need to register; however, if the period is longer than 3 years, it must be registered at Land Department.

根據泰國現行法律，外國人不得擁有土地，因此，外國人一般藉由土地租賃來獲得土地。正常情況下，租賃時雙方會簽署一份租賃合約並註明租賃期限。如租賃期限少於3年，無需進行登記；但如期限超過3年，需要在泰國土地局登記。

The maximum lease term is 30 years and is available to renew for an addition 30 years. But whether the renewal is acceptable depends on careful drafting of the clause regarding to the intention of the lease. Lands for industrial and commercial purposes may be leased for 50 years by a foreign company under certain condition. In addition, a lease contract of any immovable property for three years or less is not enforceable unless it is written and signed by responsible parties.

土地最長租賃期限為30年，期滿可以再延展一次，最長也是30年。但是，延展租賃期限的接受程度取決於草擬的意圖條款。在某些條件下，外國公司可承租工業和商業用地50年。另外，除非責任方進行書面簽署，任何3年或3年以下不動產的租賃合約均視無效。

Lands, condos and other buildings may be leased to foreigners and the term may be renewed for another 30 years. However, the renewal lease agreement is treated as a private agreement, and may not be enforceable against a person who purchases the property from the lessor or a transferee of the leased property during the first 30-year lease period.

土地、公寓和其他建築可出租給外國人，且有效期可延展一次，最長30年。但續簽的租賃合約為私人協議，如一開始承租的30年內租賃的土地被出租人賣出、或是移轉所有權給他人，續簽的租賃合約可能視為無效。

The lease shall be ended at the end of the agreed period without notice needed. But, if the lodger retains possession of the property at the end of the lease period, the term is taken as extended with the landlord’s agreement. When either party wants to terminate the lease agreement, notice should be provided.

租賃關係在期限屆滿時自動終止，不會額外通知，但如房客在租賃結束時持有土地擁有權，在房東同意下租賃期限可自動延展。當任一方要終止租賃關係，應向對方發出相關通知。
