Employee rights in relation to Work Injury 員工職災後的權利

Part I

The employer must pay compensation in the following cases to the employee:

雇主應在下列情況補償員工

           1. In case employee is exposed to danger or injury during work.

當員工在工作時暴露在危險中或受傷。

When an employee is injured or sick, the employer shall arrange appropriate medical treatment for employee immediately. In addition, the employer shall pay the actual medical expenses in accordance with the rules, procedures, conditions, and rates specified in 2017 No.2 Ministerial Regulations. Besides, the employer shall pay the medical fees without delay when is informed by the employee under section 13 of the Compensation Act.

當員工受傷或生病時,雇主應立即為員工安排適當的治療。雇主也應按照《2017年第2號部長條例》中的規定、程序、條件和費率支付實際的醫療費。此外,雇主應根據《泰國補償法》第13條規定,在員工通知醫療費後立即付款。

           2. In the event when an employee needs to rehabilitate after injury.

當員工受傷後需要進行復健。

In case an employee needs to receive work rehabilitate after the injury or illness, the employer shall pay rehabilitation fee as much as necessary according to the rules, procedures, conditions and rates specified in the Ministerial Regulations under section 15 of the Compensation Act.

當員工在工作中受傷或生病須接受復健,雇主應依據《泰國補償法》第15條規定,以《2017年第2號部長條例》中的規定、程序、條件和費率盡可能支付復健費。

          3. In case an employee suffers from perils or sickness, later disappeared or causing death, the employer shall pay the funeral expense of the employee under section 16 of the Compensation Act.

當員工因為工作受傷或生病後失蹤或死亡,雇主應依據《泰國補償法》第16條支付喪葬費。

        4. In case the employee has died without a funeral administrator, the employer shall make funeral arrangement until an entitled person requesting to be funeral administrator. But the employer cannot spend the funeral expense exceeding one third of the funeral expense, which is regulated under section 17 of the Compensation Act.

《泰國補償法》第17條規定,如員工過世時沒有葬禮執行人,在適合的人選出現前雇主應安排後事。但是雇主不得支付超過三分之一的喪葬費。

If the employee has died for 72 hours and there is no funeral administrator, the employer shall arrange the funeral according to tradition.

當員工死亡超過72小時仍沒有葬禮執行人,雇主須依據傳統安排後事。

When an employee suffers from perils or sickness leading to death or has disappeared, the following persons are eligible to receive compensation from employer under section 20 of the Compensation Act.

《泰國補償法》第20條規定,當員工受傷或生病後失蹤或死亡,以下人員可從雇主得到補償:

1.   Parents

父母

2.   Husband or wife

配偶

3.       Children under 18 years old

            未滿18歲的兒女

4.       Children from 18 years old and still being in education at a level not higher than a bachelor degree.

            已滿18歲的兒女但仍在就學中,得到學士學位後無法再接受補償。

5.       Children from 18 years old and are disabled or mentally ill, who is under the care of the employee before the employee dies or disappear.

已滿18歲但生理或心理上殘缺的兒女,在員工死亡或消失前一直受到照顧。

6.       Children who is born within three hundred and ten days from the date of death or disappearance of the employee is entitled to compensation as from the date of birth.

在員工死亡或消失前出生未滿310天的兒女,在出生後即可接受雇主補償。

7.      In case there is no entitled person from No. 1-6, the employer shall pay compensation to the dependents of the employee before the employee dies or disappear. But the said dependents must have suffered from the lack of support from employee who dies or disappears.

如員工沒有前述第1-6點的家屬,雇主應補償依附於該員工的家人,但須證明在該員工死亡或消失後造成生活不便。

Based on section 18 of the Act, the employer will pay compensation to the employee or entitled people under 20 of the Compensation Act.

《泰國補償法》第18條規定,雇主須補償員工或是第20條規定的家屬。

1.       70% of monthly salary when employee is unable to work, no matter whether such employee has lost an organ under (2) or not. The payment shall be made from the first day that the employee is unable to work until he/she is able to work, but the period is no longer than 1 year.

            當員工無法上班,不論是否如第2項失去器官,雇主須支付員工70%的薪資,自員工無法上班第一天起直到復工,但此期間不得超過1年。

2.       70% of the monthly wage for the employee in the event that such employee has lost certain organs, the payment period is prescribed by the Ministry of Labor, but not more than ten years.

            當員工失去部分器官,雇主須支付員工70%的薪資,補償期間由泰國勞動部規定,但不得超過10年。

3.       70% of the employee’s monthly salary when such employee suffers from disability, the payment period is prescribed by the Ministry of Labor, but not more than fifteen years.

            當員工成為殘疾人士,雇主須支付員工70%的薪資,補償期間由泰國勞動部規定,但不得超過15年。

4.       70% of the monthly wage for employee in event that the employee dies or disappeared for a period of ten years.

            當員工死亡或失蹤,雇主須支付員工70%薪資10

****   The term "disability" under this section means loss of organs or bodies function or loss the normal state of mind and being unable to perform normal operations at work in accordance with the rules announced by the Secretary-General with the advice of the Medical Committee.

**** 針對此條“殘疾”的定義為秘書長在醫療委員會的建議下規定的失去器官、器官或是身體無法正常運作、心智不正常無法正常上班。

In case the employer pays compensation under section 18 (2) or (3) and subsequently, the employee dies while the compensation period is not finished, the employer shall pay compensation to the person entitled under section 20 until the expiration of the period. However, the total compensation period must not exceed ten (10) years under section 19 of the Compensation Act.

《泰國補償法》第19條規定,當雇主依據第18(2)(3)條規定賠償員工,但過程中員工死亡,則雇主改補償第20條中適合的家屬直到賠償期間結束。賠償期間不超過10年。

Nevertheless, the employer does not need to pay the employee the compensation in one of the following conditions under section 22 the Compensation Act:

儘管如此,根據《泰國補償法》第22條規定,雇主在以下情況下無須賠償:

        1. The employee loses self-control after taking alcohol or other drugs.

當員工因酒精或是其他藥物導致心智不正常。

        2. The employee intentionally causes himself/herself suffers in danger or allows others to   causes himself/herself suffers in danger.

            員工故意或是允許他人使自己暴露在危險中。
