個資保護意識抬頭-泰國個資法於2020年生效
Personal Data Protection Act in Thailand
《2019（佛歷2562年）個人資料保護法》（簡稱PDPA）於2019年5月27日公告並於2020年5月27日生效，是泰國第一部針對個人資料保護設立的法案。
Personal Data Protection Act, B.E. 2562 (2019) (“PDPA”) was published on May 27, 2019 and effects on May 27, 2020. It’s the first unified data privacy legislation for personal data in Thailand.
Followings are key points about PDPA for your further understanding
以下為個資保護法重點介紹
1. PDPA regulates any data of a living person which can identify that person directly or indirectly.
PDPA管理任何可直接或間接確認他人身分的數據。
2. Any entity collecting, using, revealing and/or transferring personal data is required to comply with the PDPA as a data controller and/or a data processor.
任何實體蒐集、使用、接露或傳輸個人資料， 須以數據控制者及/或數據處理者的身分遵守PDPA的規定。
3. PDPA has extraterritorial applicability, so data controllers and data processors both in and outside Thailand is subjected to PDPA.
PDPA適用於治外法權，所以泰國境內或境外的數據控制者及數據處理者受PDPA的規範。
4. The collectors of personal data must have consent from the data subject.
個資的蒐集者須得到當事人的同意。
5. Exemptions for PDPA are personal use, public safety, operations of legislative bodies, etc.
不受PDPA影響的例外包含個人使用、公眾安全、立法機關運作等等。
6. PDPA imposes penalties for non-compliance. Data Subjects can bring a class action lawsuit, so director of a company can also be subject to penalties.
違反PDPA規定的實體會收到罰則。因當事人可以採集體訴訟，所以實體的董事長也可以能收到罰則。
