泰國申請工廠許可證的程序The procedure of requesting permission   of a new factory in Thailand

對於有意在泰國投資設廠的朋友們，IBC整理在泰國申請三種類型工廠許可證的流程如下

โรงงานจำพวก 1 Category 1 Factory  第一類工廠

ความหมาย Definition 定義

ได้แก่ โรงงานประเภท ชนิด และขนาดที่สามารถประกอบกิจการโรงงานได้ทันทีตาม ความประสงค์ของผู้ประกอบกิจการโรงงาน โดยมีเครื่องจักรไม่เกิน 20 แรงม้า และคนงาน ไม่เกิน 20 คน (อาจถูกเปลี่ยนแปลงตามกฎหระทรวงหรือประกาศตามความใน พ.ร.บ. โรงงาน (ฉบับ ที่2) พ.ศ. 2562)

Category 1 factory is a factory of the type, kind, and size, capable of factory operation immediately as desired by the factory operator

with machinery not exceeding 20 horsepower and not more than 20 workers. (Subjected to revision by sub-regulations of Factory Act (No. 2) B.E. 2562)

根據工廠的類型和規模，可以依照經營者的希望立即開始營運。廠內機器的使用功率不超過20馬力、且僱用的工人不超過20位。

-ไม่ต้องยื่นขออนุญาต No need to apply for permission 無需申請許可

-ประกอบกิจการได้ ทันที Can run immediately可以立即營運

-ต้องปฏิบัติตามหลักเกณฑ์ที่กำหนด ในกฎกระทรวงทั้งเรื่องที่ตั้งโรงงาน, ลักษณณะอาคาร, เครื่องจักร, การควบคุมการปล่อยของเสียหรือ         

Must follow Criteria in both ministerial regulations Matters relating to plant locations, characteristics of buildings, machinery, control of waste discharges, or –

必須遵守在兩個部長條例中制定有關工廠位置、建築物特點、機器、及廢物排放控管的規定或;

โรงงานจำพวก 2 Category 2 Factory 第二類工廠

ความหมาย Definition 定義

ได้แก่ โรงงานประเภท ชนิด และขนาดที่เมื่อจะประกอบกิจการโรงงานต้องแจ้งเป็นหนังสือให้ผู้อนุญาตทราบก่อน โดยมีเครื่องจักรไม่เกิน 50 แรงม้า และคนงานไม่เกิน 50 คน และไม่จัด อยู่ในจำพวกที่ 1

Category 2 factory is a factory of the type, kind, and size, shall notify in writing the competent official prior to commencement of factory operation with machinery not exceeding 50 horsepower and not more than 50 workers and not being classified as group 1.

根據工廠的類型和規模，經營者在開工前必須通知相關部門並收到確認。有別於第一類工廠的規定，此類工廠機器的使用功率不可超過50馬力、且雇用的工人不能超過50位。

• ตั้งโรงงานได้ทันที แต่ทำเลต้องเป็นไปตามกฎกระทรวง ฉบับที่ 2 (พ.ศ.2535) ข้อ 1

              Set up the factory immediately but the location must comply with the Ministerial Regulation No. 2 (1992) Article 1

              可立即建立工廠，但是地點必須符合《1992年第2號部長條例》第1條的規定

• แจ้งการประกอบกิจการโรงงานจำพวกที่ 2 ตามแบบ ร.ง.1

              Notify  the operation of the Category 2 factory in accordance to Ror.Ngor. 1   依據第1號規則通知第2類工廠即將營運

-       ชำระค่าธรรมเนียมรายปี Annual fee payment支付年費

-       รับใบรับแจ้งการประกอบกิจการโรงงานจำพวกที่ 2  Receive a notification of factory operation for Category 2 factory   收到第2類工廠即將營運的通知

-       เริ่มการประกอบกิจการ Start operations 開始營運

-      ชำระค่าธรรมเนียมรายปี ทุกปี ในวันครบรอบวันเริ่มประกอบกิจการ 

        Pay the annual fee every year starting from the date of business operation 在每年的開工周年日支付年費。

โรงงานจำพวก 3 Category 3 Factory  第三類工廠

ความหมาย Definition 定義

ได้แก่ โรงงานประเภท ชนิด และขนาดที่การตั้งโรงงานจะต้องได้รับใบอนุญาตก่อน จึงจะดำเนินการได้ โดยมีเครื่องจักรเกิน 50 แรงม้า และคนงานเกิน 50 คน

Category 3 Factory is a factory of the type, kind and size that must  obtain permission from a license grantor prior to a continuation of factory operation with machinery over 50 horsepower and over 50 workers.

根據工廠的類型和規模，必須先獲得工廠許可證，才可以營運擁有使用功率50馬力以上的機器、和雇用超過50名工人的工廠。

• ยื่นเอกสารเพื่อดำเนินการรับฟังความคิดเห็นของประชาชน  

               submit documents for public hearing提交公聽會文件 

• ยื่นคำขอรับใบอนุญาต (แบบ ร.ง.3) และ เอกสาร ผลการรับฟังความคิดเห็นของประชาชน

Submit a request for a permit (Form Ror. 3) and the public hearing results document  提交許可申請（第3號表格）和公聽會結果

• เจ้าหน้าที่พิจารณาความถูกต้องของเอกสาร/ สถานที่ตั้งโรงงาน

The officer checking for accuracy of documents / Factory location  工業部的官員檢查文件/工廠所在地

•  ภายในระยะเวลาตามที่ กำหนดในประกาศกระทรวง (30วัน) ( ระยะเวลาที่มีการเรียกบุคคลหรือเอกสารหรือวัตถุใด มาเพื่อประกอบการพิจารณาจะไม่นับรวมระยะเวลาการพิจารณาคำขอตามที่กำหนด)

Within the specified period prescribed in the Ministry's announcement (30 days) (this is the period when people or documents or objects are called for consideration, will not include the request for consideration period as specified)

在工業部要求的期限內（30天）進行補正，此期限不含考慮期限。

• แจ้งผลการพิจารณา Notification of results 通知結果

ตามระเบียบกระทรวงอุตสาหกรรม ว่าด้วยการรับฟังความคิดเห็นของประชาชนในการพิจารณาออกใบรับแจ้งการประกอบ กิจการโรงงาน ใบอนุญาตประกอบกิจการโรงงาน และใบอนุญาตขยายโรงงาน ตามกฎหมายว่าด้วยโรงงาน (ฉบับที่ ๒ พ.ศ. ๒๕๕๗ )

According to the regulations of the Ministry of Industry, after their consideration to the opinions of the public, it is based on their discretion to issue factory operation receipt, factory operation license and factory expansion licenses Under the law on factories (Issue 2 B.E. 2557)

根據工業部的規定，審查員在考慮了公眾意見之後，會根據《第2B.E.2557號工廠法》核發工廠營運收據，工廠營運許可證和工廠擴建許可證。

-พิจารณารายงาน ประเมินความเสี่ยง / ESA (ถ้ามี) Consider the assess of the risk / ESA (if any) 考慮評估風險報告/ ESA（如果有）

-พิจารณารายงาน EHIA (ถ้ามี) Consider the EHIA report (if any) 考慮EHIA報告（如果有）。

-พิจารณารายงาน EIA (ถ้ามี) Consider the EIA report (if any) 考慮環境影響評估報告（如果有）。

อนุญาต Permission Granted 核准許可申請

• รับใบอนุญาต/ชำระค่าธรรมเนียมใบอนุญาต  Get a license / pay license fees 獲得許可證/支付許可證費用
• ตั้งโรงงานภายในระยะเวลาที่กำหนดในใบอนุญาต  

             Set up a factory within the time period specified in the license  在許可證指定的時間內設置工廠

แจ้งเริ่มประกอบกิจการ /ชาระค่าธรรมเนียมรายปี (ก่อนเริ่มประกอบกิจการ ๑๕ วัน)

Notice of commencement of business / Pay annual fee (15 days before operating the business)

在開工的15天前發開工通知並繳納年費

• เริ่มประกอบกิจการ เริ่มนับอายุใบอนุญาต Start the business. Start counting the license period. 從營運第一天就開始計算許可證的年限。
• ชาระค่าธรรมเนียมรายปี (ทุกปี) Pay annual fees (every year) 每年支付年費
• ต่ออายุใบอนุญาต Renew license 更新許可證

ไม่อนุญาต Permission NOT Allowed 駁回許可申請

-อุทธรณ์ต่อรัฐมนตรีว่าการกระทรวงอุตสาหกรรม ภายใน 30 วัน

Appeal to the Minister of Industry within 30 days 在30天內向工業部上訴

-ไม่อนุญาต (ยกอุทธรณ์) Cannot Appeal 不允許上訴

-อนุญาต Permission Granted 核准許可申請

๑. ใบอนุญาตมีอายุ ๕ ปีปฏิทิน

๒. วันครบรอบชำระค่าธรรมเนียมรายปี เป็นวันเดียวกันกับวันครบรอบ ๑ ปี ของ

วันเริ่มประกอบกิจการ

1. The license is valid for 5 calendar years.  許可證有效期為5年

2. Anniversary of the annual fee payment Is the same day as the 1-year anniversary when the business commences.

   在每年的開工周年日支付年費。

ความหมาย Definition 定義

โรงงาน Factory 工廠อาคาร สถานที่ หรือยานพาหนะที่ใช้เครื่องจักรมีกำลังรวมตั้งแต่ห้าสิบแรงม้าหรือกำลังเทียบเท่าตั้งแต่ห้าสิบแรงม้าขึ้นไป หรือใช้คนงานตั้งแต่ห้าสิบคนขึ้นไปโดยใช้เครื่องจักรหรือไม่ก็ตาม เพื่อประกอบกิจการโรงงาน  ทั้งนี้ ตามประเภทหรือชนิดของโรงงานที่กำหนดในกฎกระทรวง

“Factory” means buildings, premises, or vehicles using machine with total power from 50 horsepower or equivalent of 50 horsepower or more or which employ 50 workers or more with or without machinery to engage in factory operation in accordance with the type or kind of factory as prescribed in the Ministerial Regulations.

依據《部長條例》規定，工廠為任何使用功率50馬力以上的機器、或雇用50人以上的工人來從事製造、生產、安裝、修理、維護、測試、改進、加工、運輸、儲存或損壞以及其他所規定的行為。
