泰國勞工保護法中英版新舊比較   Previous & New Thai Labor Law Comparison (Ch&Eng)

The National Legislative Assembly of Thailand has passed amendment to the Labor Protection Act B.E. 2541 (1998) on 5th April 2019, by issuing a new draft of Labor Protection Act (no. 7) B.E. 2562 (2019). We are pleased to summarize the details in the table below.

201945號泰國國會正式通過1998 (佛曆2541)泰國勞工保護法修訂,新的2019(佛曆2562)泰國第7號勞工法護法已生效。IBC將新舊法整理細節如下:

Business leave

事假

Previous provision provides the employer to determine whether to provide business leave with or without pay.

由雇主決定是否提供帶薪或

無薪的事假

Change to a minimum of 3 days paid business leaves per year. For more than 3 days would be based on relevant employer’s work regulations and could provide additional leave without pay basis.

每年至少提供三天帶薪事假。超過三天將會根據雇主的工作規定來決定是否會增加天數。

Maternity leave

產假

90 days (maximum) of maternity leave to pregnant employees per pregnancy including check-up prior to child delivery.

員工懷孕最長可請90產假,包含產前檢查。

98 days (maximum) of maternity leave to pregnant employees per pregnancy including check-up prior to child delivery.

員工懷孕最長可請98產假,包含產前檢查。

Relocation of the employer’s business

變更工作地點

Only need to provide 30 days’ advance notice only if such relocation would materially affect the ordinary living conditions of the employees and/or their family with entitlement to special severance pay not less than the rate of severance pay under Section 118 of the Labor Protection Act.

只有在搬遷會重大影響員工以及家庭的生活條件下,才需要提前30天通知,並且可享有特別資遣費,但不低於勞工保護法第118條之規定。

Compulsory to provide 30 days’ advance notice for such relocation with entitlement to special severance pay not less than the rate of severance pay.
